General shipping and payment terms

§1. General

1.1 The following conditions apply to all our offers, sales, deliveries and services and become part of the contract.

1.2 Deviating regulations are only valid if they have been individually agreed between us and the customer.

§2 offers and orders

Our offers are initially subject to change unless they are designated as binding in writing. Your order represents an offer to us. An effective contract is therefore only concluded with our order confirmation in text form (also by email) or the delivery of the goods.

§3 prices

3.1 Unless otherwise agreed, prices for dispatch or delivery are plus the costs for packaging, transport and freight insurance, in accordance with the contractual agreement. All prices are stated including the statutory VAT applicable in Germany.

3.2 We accept no liability for printing or transcription errors in the price labeling.

§4 retention of title

4.1 We reserve title to the purchased item until the purchase price claim has been settled.

4.2 Accordingly, delivered items may not be changed or sold without our consent.

§5 delivery time

5.1 We would like to point out that all information on the availability, shipping or delivery of a product are only approximate information and approximate guide values. They do not represent binding or guaranteed shipping or delivery dates, unless these are expressly designated as binding dates or have been agreed as binding dates. If, while processing your order, we discover that the products you have ordered are not available, you will be informed separately by e-mail. If we are unable to deliver the ordered goods through no fault of our own because the supplier does not fulfill his contractual obligations, we are entitled to withdraw from the contract with you. In this case you will be informed immediately that the ordered product is not available. Your statutory rights are unaffected.

If delivery to you is not possible because the delivered goods do not fit through your front door, front door or staircase or because you cannot be found at the delivery address you have given, although the delivery time has been announced to you with a reasonable period of time, you will bear the costs for unsuccessful delivery.

§6 shipping

6.1 The risk of accidental loss and accidental deterioration of the goods - also in the case of mail order purchases - does not pass until the goods are handed over to the buyer. The transfer is the same if the buyer is in default of acceptance.

6.2 Unless expressly agreed otherwise in writing, we are entitled to make partial deliveries to a reasonable extent.

§7 payment, default

7.1 Prices are due after conclusion of the contract, in accordance with the contractual agreement, but at the latest when the goods are made available and are to be paid without deduction. In addition, the statutory provisions apply, especially in the event of default, §§286 and 288 BGB.

7.2 The buyer is only entitled to offset if his counterclaims have been legally established or are undisputed. The buyer is only authorized to exercise a right of retention if his counterclaim is based on the same contractual relationship.

§8 Warranty / liability for material defects

8.1 The statutory provisions apply, unless otherwise agreed.

8.2 The limitation period for claims from material defects is two years for consumers and begins with the delivery of the purchased item.

8.3 The limitation period for used items is 12 months from delivery of the goods.

8.4 If the goods show a material defect, the buyer has the right to supplementary performance (subsequent delivery or improvement) at his option. According to As a rule, §440 BGB gives the right to two subsequent performance, unless something else arises, in particular from the nature of the object of purchase or the defect or other circumstances.

The buyer is only entitled to warranty rights if the purchased item was defective when the risk passed.

8.5 If we are not able to provide supplementary performance in accordance with the statutory provisions or if this is delayed beyond a reasonable period to be set by the buyer for reasons for which we are responsible, or if supplementary performance fails in any other way, the buyer is entitled to choose to withdraw from the contract or to demand a corresponding reduction in the purchase price. In the event of only minor defects in the purchased item, withdrawal from the contract is excluded. Such a defect only entitles to a reduction.

8.6 In the event of subsequent delivery or withdrawal, the buyer has to pay compensation for the period of use of the object of purchase in accordance with Section 346 of the German Civil Code.

§9 Compensation

9.1 We are liable in cases of willful intent or gross negligence in accordance with the statutory provisions. The liability for guarantees is independent of fault. We are only liable for slight negligence in accordance with the provisions of the Product Liability Act, for injury to life, limb or health, or for breach of essential contractual obligations. The claim for damages for the slightly negligent breach of essential contractual obligations is limited to the contract-typical, foreseeable damage, unless liability is due to injury to life, body or health. We are liable to the same extent for the fault of vicarious agents and representatives.

9.2 The regulation of the preceding paragraph extends to compensation for damages in addition to the performance, compensation for damages instead of performance and the claim for compensation due to futile expenses, regardless of the legal reason, including liability for defects, delay or impossibility.

§10 data protection, place of performance and miscellaneous

10.1 The buyer agrees that we save the data necessary to process the business relationship. We insure that the data will only be used in-house and will not pass it on to unauthorized third parties.

10.2 The place of performance for the obligation is our place of business, unless otherwise stated in the order confirmation or the contract.

§11 Different delivery addresses

If you have chosen PayPal as your payment method, we will check the addresses you have stored, both with us and with the PayPal transaction. If the addresses differ, we will deliver to the address that is stored in PayPal. This serves the seller protection and secures us legally.
